Article 2: Purpose
These General Terms and Conditions of Sale (GTC) govern all sales concluded on the website williamj11.sg-host.com between CER and any customer wishing to purchase one or more products and/or one or more services offered for online sale by CER (hereinafter the “Customer”). The GTC in effect on the date of order confirmation supersede any conflicting terms or stipulations and, where applicable, cancel and replace any previous online terms and conditions of sale that may have governed the relationship between CER and the Customer.
Placing an online order implies the Customer’s prior acceptance of the General Terms and Conditions of Sale (GTCS) and the specific terms of sale in effect on the date of order confirmation. The Customer declares having read the GTCS in effect prior to placing any order and accepts them in full and without reservation. CER reserves the right to modify the content of the GTCS at any time.
In the event of modification, the modified version of the CGVEL will apply from the date of its posting on the website williamj11.sg-host.com to any order for Product(s) and/or Service(s) placed after this posting.
Article 3: Products and Services
The products and services offered for sale online by CER (hereinafter the “Products” and the “Services”) are those presented on the website williamj11.sg-host.com on the day of confirmation of the order.
The essential characteristics and prices of the Products and Services are indicated on the product sheets published online by CER and accessible from the website williamj11.sg-host.com. Any photographs reproduced on these sheets and this website are not contractual.
The Customer acknowledges having reviewed the essential characteristics and prices of the Products and Services in effect on the date of order confirmation. Products and Services are offered for sale online subject to availability.
In the event that a Product or Service ordered is unavailable, the Customer will be informed as soon as possible that the order cannot be confirmed or must be cancelled. The Customer will then have the option of being reimbursed for the price of the Product or Service.
Services ordered must be provided within fourteen (14) days of the refund request.
Article 4: Communication by electronic means
The Customer agrees that information and documents relating to the conclusion and/or execution of a sales contract concluded under these General Terms and Conditions of Sale will be sent to him by email to the email address he provided when placing his order on the website williamj11.sg-host.com .
Article 5: Orders
All orders for Products and/or Services are placed on the website williamj11.sg-host.com according to the following terms and steps:
Step 1: Consult the CER Online Code homepage
Upon arriving at the CER online coding website’s homepage, visitors are presented with the online coding services offered by CER and are invited to click on the tab, located in the upper right or lower right corner of the page, entitled “Succeed in your coding training”. Clicking on this tab will then redirect visitors to a form page.
Step 2: Entering Personal Information / Registering and Creating an Online Account. The visitor is then directed to a form page to collect all the information necessary for identification and order processing. The required fields are title, last name, first name, date of birth, address, postal code, city, and email address. The visitor is offered other fields to complete, but there is no obligation to proceed to the next step.
Following this, the visitor must select the practical training course they wish to undertake. Three courses are then offered. Before finalizing this step, the visitor must check the box to accept the terms and conditions of sale in order to proceed to the next page. The terms and conditions of sale are accessible to everyone by clicking on the blue link. To move on to the third step, the visitor must click on the “Next” button.
Step 3: Selecting a CER Driving School. The visitor then sees a list of CER driving schools located near the postal address provided in the previous step. Several CER driving schools are offered, and the visitor can contact their chosen school for advice and information by clicking “Choose.” Selecting a CER driving school is not mandatory to proceed; regardless of whether they choose a school, the visitor simply clicks “Next.”
Step 4: Order Summary . The visitor reviews their order summary. This summary includes the personal information, the CER center, and the planned practical training course previously entered by the visitor. Further down on the same page, the visitor can view their order details: – the order reference – the product, which includes access to the online code – the total price including VAT. The visitor then clicks on “Pay by Card” to proceed to the next step.
Step 5: Selecting the Order Payment Method. The visitor is then redirected to the secure PAYBOX server to finalize the transaction. The visitor selects their payment method, such as credit card. For example, if they wish to pay by credit card, they select the card type (CB, VISA, MASTERCARD) and click on “Make Payment” to confirm their purchase. If they do not wish to confirm the transaction, they click on “Cancel” at the bottom of the page. Step 6: Order Payment. By clicking on “Make Payment,” the visitor remains on the secure PAYBOX platform. If they wish to confirm their transaction, they enter their bank details (card number, expiry date, and security code). They click on “Confirm” to finalize the transaction. They also have the option to cancel the process by clicking on the “Cancel” button or return to the previous step by clicking on the “Back to Payment Method Selection” button. If the transaction is accepted, the visitor is redirected to a CER page confirming that their order has been received. At the same time, the visitor receives an email containing their username and password to log in to their CER account and begin their driver’s education course. CER then sends the customer an email confirming their order and including an order number and a summary of their order.
Article 6: Evidence
The information recorded by CER’s computer systems constitutes proof of all operations – from order to payment – carried out with the Client.
Article 7: Personal situation
The Client undertakes, for the entire duration of any contract concluded under these General Terms and Conditions of Sale, to inform CER of any change to their email address and postal address.
Article 8: Data Processing and Freedoms
The personal data provided by the Customer when placing an order on the website is processed automatically and recorded and stored in a computer file. The Customer has the rights of access and rectification provided for by French Law No. 78-17 of 6 January 1978, as amended, concerning information technology, data files and civil liberties. CER has registered this file with the French Data Protection Authority (CNIL).
Article 9: Price
The prices of Products and Services are indicated in euros, inclusive of all taxes and, where applicable, excluding shipping, insurance, and delivery charges. The amount of any additional charges payable by the Customer is specified at the time of ordering. CER reserves the right to modify its prices at any time. In the event of a modification, the new prices will apply from the date they are published online at williamj11.sg-host.com to orders confirmed by the Customer after that date.
Article 10: Payment Terms
Payment is made exclusively and in full by credit card at the time of ordering.
Article 11: Delivery of Products
Product delivery is available throughout metropolitan France. Products are delivered to the postal address provided by the Customer when placing their order. CER cannot be held liable for any difficulties or inability to deliver Products if the Customer makes an error when entering their order information. Any additional costs incurred due to these difficulties or inability to deliver will be borne exclusively by the Customer. Products will be delivered no later than 30 (thirty) days from CER’s receipt of full payment. Risk of loss or damage to the Products passes to the Customer when they, or a third party designated by them (other than the carrier proposed by CER), takes physical possession of the Products.
The Customer is required to check the condition of all delivered packages, as well as their conformity to the information on the corresponding order and delivery notes. Any reservations or claims must be clearly stated by the Customer on the corresponding delivery note. If necessary, the Customer must confirm their reservations by sending a registered letter with acknowledgment of receipt to the carrier within a maximum of forty-eight (48) hours of receiving the Products. Within the same timeframe, the Customer must send a copy of this letter to CER by registered letter with acknowledgment of receipt to the following address: CER KARL RAOULT, 67 rue de Longpaon, 76160 Darnétal, France.
Any reservation or claim must be expressly justified and include the order reference. Except in the case of the Customer exercising their right of withdrawal in accordance with the legal requirements and timeframe, no Product returns will be accepted without prior written authorization from CER. All Product returns will be made at the Customer’s expense and risk. After verification of the quantity and quality of the returned Products, any Product return not resulting from the Customer’s exercise of their right of withdrawal and accepted by CER will result in the issuance of a credit note to the Customer or a refund of the sums paid at the time of the order.
Article 12: Provision of Services
The provision of Services will take place no later than seven (7) days from CER’s receipt of full payment. CER shall not be liable under any circumstances for any malfunction, anomaly, or damage resulting from the Internet network, such as data loss, intrusion, viruses, or service interruptions during the placement of an order on the website.
Article 13: Right of withdrawal
The Customer has a period of fourteen (14) days to exercise their right of withdrawal without having to justify their decision or bear any costs other than those provided for in Articles L. 221-23 to L. 221-25 of the Consumer Code. When the contract concluded between CER and the Customer concerns the
For the provision of one or more Services, this period begins the day after the contract is concluded. When the contract between CER and the Client concerns the delivery of one or more Products, this period begins the day after the delivery date of the ordered Product, or the delivery date of the last Product ordered in the case of a group order of several Products. The withdrawal period begins at the start of the first hour of the first day and ends at the end of the last hour of the last day of the period. If it expires on a Saturday, Sunday, or public holiday, this period is extended until the next working day. To exercise their right of withdrawal, the Client must inform CER of their decision to withdraw by sending, before the expiry of the withdrawal period, an unambiguous statement expressing their intention to withdraw. For this purpose, the Client may use the detachable form which is provided in Appendix 2.
If the contract concluded between CER and the Client relates to the delivery of one or more Product(s), the Client must, within a maximum period of fourteen (14) days following the communication to CER of his decision to withdraw, return to the address indicated on the invoice the Product(s) concerned, in their perfect original condition, accompanied by all possible accessories, instructions for use and documentation.
All returns of Product(s) will be at the Customer’s expense and risk. Subject to compliance with the above conditions, CER undertakes to reimburse the Customer for the price of their order, as well as, where applicable, delivery charges, within fourteen (14) days. When the contract between CER and the Customer concerns the provision of one or more Services, this period begins from the date on which the Customer informs CER of their decision to withdraw.
When the contract between CER and the Client relates to the delivery of one or more Product(s), this refund period runs from the date of receipt by CER of the returned Product(s), or from the date of transmission by the Client of proof of shipment of the returned Product(s) to CER, the date to be retained being that of the first of these events.
If the Client wishes for the performance of a Service to begin before the end of the withdrawal period, CER will obtain their express request by any means. A Client who has exercised their right of withdrawal from a Service contract, the performance of which has begun, at their express request, before the end of the withdrawal period, will pay CER an amount corresponding to the service provided up to the point of notification of their decision to withdraw. This amount will be proportional to the total price of the Service agreed upon in the contract. The articles of the Consumer Code relating to the right of withdrawal applicable to contracts concluded under these General Terms and Conditions of Sale are reproduced in Appendix 1.
Article 14: Guarantee of conformity and guarantee against hidden defects
The Products are covered by the legal guarantee of conformity mentioned in Articles L. 217-4 to L. 217-14 of the French Consumer Code, as well as by the guarantee against hidden defects in the goods sold, under the conditions set forth in Articles 1641 to 1648 and 2232 of the French Civil Code. In the event of a lack of conformity, the Customer has two (2) years from the delivery of the non-conforming Products to invoke the CER guarantee. The Customer may not contest the conformity of the Products by invoking a defect that they knew of or could not have been unaware of at the time of purchase. If acting under the legal guarantee of conformity, the Customer may choose between repair or replacement of the Product.
However, CER is not bound by the Customer’s choice if that choice results in a clearly disproportionate cost compared to the alternative, taking into account the value of the goods or the significance of the defect. The warranty does not cover defects caused by abnormal or improper use, or resulting from a cause unrelated to the intrinsic qualities of the Products. All warranties are excluded in the event of misuse, improper storage, negligence, or lack of maintenance by the Customer, as well as in the event of normal wear and tear or force majeure. The warranty is also excluded in the event of failure to comply with the operating instructions provided with the Products. If acting under the legal guarantee of conformity, the Customer is not required to provide proof of the existence of the lack of conformity of the goods during the twenty-four months following delivery of the Product. The legal guarantee of conformity applies independently of any commercial warranty that may be granted by CER.
The foregoing provisions do not preclude the application of the warranty against defects in the goods sold, under the conditions set forth in Articles 1641 to 1648 and 2232 of the French Civil Code. Where applicable, the Customer may choose between rescinding the sale or obtaining a reduction in the sale price in accordance with Article 1644 of the French Civil Code.
Article 15: CER’s Responsibility
CER shall in no case be held liable for failure to perform any of its obligations if such failure is attributable to the Client, to the unforeseeable and insurmountable act of a third party to the contract, to a fortuitous event or force majeure.
Events or circumstances that are irresistible, unforeseeable and beyond the control of the parties are considered to be unforeseeable events or circumstances that exempt them from liability, including social movements, demonstrations, wars, embargoes, unavailability of raw materials necessary for the manufacture of products, total or partial strikes by carriers, and natural disasters.
Article 16: Quality
CER adheres to the Quality Charter of the Association Centre d’Education Routière, the content of which can be consulted on the website williamj11.sg-host.com
The Client is informed that he may be contacted as part of CER’s quality process to respond to a satisfaction survey or audit.
Article 17: Applicable Law and Language
Any sales contract concluded between CER and the Client on the website williamj11.sg-host.com, as well as these General Terms and Conditions of Sale and the specific conditions accepted by the Client, are subject to French law.
The language of contracts concluded in connection with orders placed on the website williamj11.sg-host.com is French.
Article 18: Disputes
All disputes relating to orders placed under these General Terms and Conditions of Sale, even in the event of a third-party claim or multiple defendants, will be subject to an attempt at resolution.
Amicable resolution through mediation will be sought prior to any legal action. If mediation fails, disputes will fall under the jurisdiction of the court in the Client’s place of residence or the place where the harmful event occurred.
Article 19: Amicable recourse
In the event of a dispute relating to an order placed under these General Terms and Conditions of Sale, the Customer may seek an amicable resolution from CER. This resolution must be submitted by registered letter with acknowledgment of receipt sent to the following address: CER Réseau, 88 rue La Fayette, 75009 Paris, France. CER undertakes to provide a written response within seven (7) business days of receiving the Customer’s amicable resolution letter. CER’s written response will be sent to the Customer by registered letter with acknowledgment of receipt to the postal address provided by the Customer when placing the order in question or, if applicable, to the most recent postal address provided by the Customer pursuant to Article 7.
Article 20: Consumer Mediation
The Customer may, under the conditions set forth in Articles L. 612-1 et seq. and R. 612-1 et seq. of the French Consumer Code, have recourse, free of charge, to a consumer mediator for the amicable resolution of any dispute between the Customer and CER arising from an order placed pursuant to these General Terms and Conditions of Sale. Article 21: Insurance
CER is insured under Article L. 211-1 of the Insurance Code by GOUPIL ASSURANCES, 15 rue du Mont Durville 76107 ROUEN CEDEX.
Article 22: Contract Archiving
Contracts concluded between CER and the Client on the website williamj11.sg-host.com, which consist of the data entered by the Client during their online order, as well as the versions of the General Terms and Conditions of Sale (GTCS) and the specific online sales conditions in effect on the date of confirmation of this order and accepted by the Client, are archived for a period of ten (10) years. When the contract concluded between CER and the Client concerns the sale of a Product, this archiving period expires ten (10) years after the date of delivery of the Product. When the contract concluded between CER and the Client concerns the sale of a Service, this archiving period expires ten (10) years after the date of delivery of the Product. The Client may access the archived contracts to which they are a party by sending a request by email to the email address indicated in Article 1 of these GTCS.
APPENDIX 1: RIGHT OF WITHDRAWAL APPLICABLE TO DISTANCE CONTRACTS
Extracts from the Consumer Code: Article L. 221-18 The consumer has a period of fourteen days to exercise their right of withdrawal from a contract concluded remotely, following telephone solicitation or off-premises sales, without having to justify their decision or bear any costs other than those provided for in Articles L. 221-23 to L. 221-25. The withdrawal period begins on the day: 1° The contract is concluded, for service contracts and those mentioned in Article L. 221-4; 2° The goods are received by the consumer or a third party, other than the carrier, designated by the consumer, for contracts for the sale of goods. For contracts concluded off-premises, the consumer may exercise their right of withdrawal from the date the contract is concluded. In the case of an order for several goods delivered separately, or in the case of an order for goods consisting of multiple lots or parts whose delivery is staggered over a defined period, the withdrawal period begins upon receipt of the last good, lot, or part. For contracts providing for the regular delivery of goods over a defined period, the withdrawal period begins upon receipt of the first good. Article L. 221-19 In accordance with Council Regulation (EEC) No 1182/71 of 3 June 1971 laying down rules applicable to time limits, dates and periods: 1° The day on which the contract is concluded or the day of receipt of the goods is not counted in the period mentioned in Article L. 221-18; 2° The period begins to run at the start of the first hour of the first day and ends at the end of the last hour of the last day of the period; 3° If this period expires on a Saturday, Sunday or public holiday, it is extended until the next working day. Article L. 221-20 When information relating to the right of withdrawal has not been provided to the consumer under the conditions set out in point 2° of Article L. 221-5, the withdrawal period is extended by twelve months from the expiry of the initial withdrawal period, determined in accordance with Article L. 221-18. However, when this information is provided during this extension, the withdrawal period expires at the end of a period of fourteen days from the day on which the consumer received this information. Article L. 221-21 The consumer exercises their right of withdrawal by informing the professional of their decision to withdraw by sending, before the expiry of the period provided for in Article L. 221-18, the withdrawal form mentioned in point 2° of Article L. 221-5 or any other unambiguous statement expressing their intention to withdraw. The professional may also allow the consumer to complete and submit online, on their website, the form or declaration provided for in the first paragraph. In this case, the professional must immediately provide the consumer with an acknowledgement of receipt of the withdrawal on a durable medium. Article L. 221-22 The burden of proof for exercising the right of withdrawal under the conditions provided for in Article L. 221-21 rests with the consumer. Article L. 221-23 The consumer returns or hands over the goods to the professional or to a person designated by the latter,without undue delay and, at the latest, within fourteen days of the communication of his decision to withdraw in accordance with Article L. 221-21, unless the professional offers to recover these goods himself.
The consumer is only liable for the direct costs of returning the goods, unless the professional agrees to bear these costs or has failed to inform the consumer that they are responsible for them. However, for contracts concluded off-premises, when the goods are delivered to the consumer’s home at the time the contract is concluded, the professional must collect the goods at their own expense if they cannot be returned by mail due to their nature. The consumer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and proper functioning of the goods, provided that the professional has informed the consumer of their right of withdrawal, in accordance with point 2 of Article L. 221-5. Article L.221-24: When the right of withdrawal is exercised, the professional must reimburse the consumer for all sums paid, including delivery costs, without undue delay and at the latest by 2025.

For contracts for the sale of goods, unless the trader offers to collect the goods themselves, the trader may withhold reimbursement until the goods have been received or until the consumer has provided proof of shipment of the goods, whichever is the earliest. Article L.221-25 If the consumer wishes the performance of a service or a contract mentioned in the first paragraph of Article L. 221-4 to begin before the end of the withdrawal period mentioned in Article L. 221-18, the professional must obtain their express request by any means for distance contracts and in writing or on a durable medium for off-premises contracts. A consumer who has exercised their right of withdrawal from a service contract or a contract mentioned in the first paragraph of Article L. 221-4, the performance of which has begun, at their express request, before the end of the withdrawal period, must pay the professional an amount corresponding to the service provided up to the point of notification of their decision to withdraw; this amount is proportional to the total price of the service agreed upon in the contract. If the total price is excessive, the appropriate amount is calculated based on the market value of what has been provided. No sum is due from the consumer who has exercised their right of withdrawal if their express request was not obtained pursuant to the first paragraph or if the professional has not complied with the information obligation provided for in point 4° of Article L. 221-5. Article L.221-26 The consumer who has exercised their right of withdrawal from a contract for the supply of digital content not supplied on a tangible medium is not liable for any sum if: 1° The professional has not obtained their express prior consent for the performance of the contract before the end of the withdrawal period as well as proof of their waiver of their right of withdrawal; 2° The contract does not include the information required under the second paragraph of Articles L. 221-9 and L. 221-13. Article L.221-27 The exercise of the right of withdrawal terminates the obligation of the parties either to perform the distance contract or the off-premises contract, or to conclude it when the consumer has made an offer.Exercising the right of withdrawal from a main contract at a distance or off-premises automatically terminates any ancillary contract, without costs to the consumer other than those provided for in Articles L. 221-23 to L. 221-25.
Article L.221-28 The right of withdrawal cannot be exercised for contracts:
1°) Supply of services fully performed before the end of the withdrawal period and whose performance began after the consumer’s express prior agreement and express waiver of their right of withdrawal;
2°) Supply of goods or services whose price depends on fluctuations in the financial market which are beyond the control of the professional and which may occur during the withdrawal period;
3°) Supply of goods made to the consumer’s specifications or clearly personalized;
4°) Supply of goods liable to deteriorate or expire rapidly;
5°) Supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;
6°) Supply of goods which, after delivery, are, by their nature, inseparably mixed with other articles;
7°) Supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose value agreed upon at the conclusion of the contract depends on market fluctuations beyond the control of the professional;
8°) Maintenance or repair work to be carried out urgently at the consumer’s home and expressly requested by him, within the limit of spare parts and work strictly necessary to respond to the emergency;
9°) The supply of audio or video recordings or computer software which have been unsealed by the consumer after delivery;
10°) Supply of a newspaper, periodical or magazine, except for subscription contracts for these publications;
11°) Concluded during a public auction;
12°) Provision of accommodation services, other than residential accommodation, transport services for goods, car rentals, catering or leisure activities which must be provided on a specific date or during a specific period;
13°) The supply of digital content not supplied on a tangible medium where performance has begun after the consumer’s prior express consent and express waiver of their right of withdrawal.
